Last updated

This Privacy Policy explains how ProSearch LLC ("ProSearch," "ProSearch Advisory," "we," "us," or "our") collects, uses, discloses, and protects information about you when you visit this website (the "Site"), contact us, or engage our services (the "Services"). It also describes the choices and rights you have. By using the Site or the Services, you acknowledge the practices described in this Policy. If you do not agree, please do not use the Site or the Services.

1. Who we are

ProSearch LLC is a Texas limited liability company based in Austin, Texas, providing advisory and consulting services to staffing firm owners and recruitment founders. For the purposes of applicable data-protection laws, we act as the controller of the personal information described in this Policy, except where we process information on a client's behalf as part of an engagement, in which case that client is the controller.

2. Information we collect

We collect only the information reasonably needed to operate the business, deliver the Services, and respond to you:

  • Information you provide. Your name, email address, phone number, company, role, and any details, documents, or context you share when you contact us, book a session, complete a form, or take part in an engagement.
  • Payment information. When you pay for a session or engagement, payment is collected and processed by our third-party payment processor. We receive limited transaction details (such as confirmation, amount, and the last four digits of a card) but we do not collect or store your full payment card number on our systems.
  • Communications. Records of your correspondence with us, including emails, messages, scheduling details, and notes related to your session or engagement.
  • Usage and device information. Information collected automatically when you visit the Site, such as IP address, general location, browser and device type, pages viewed, referring pages, and dates and times of access, typically through cookies and similar technologies and analytics tools.

We do not knowingly collect personal information from anyone under 18. The Site and Services are intended for business and professional use, not for children.

3. How we use your information

We use the information we collect to:

  • Schedule, provide, support, and follow up on sessions, engagements, and the Services;
  • Process payments, issue receipts, and keep books and records required for accounting and tax;
  • Communicate with you, respond to inquiries, and send service-related messages;
  • Operate, maintain, secure, analyze, and improve the Site and the Services;
  • Detect, prevent, and address fraud, abuse, security incidents, and technical issues;
  • Comply with our legal obligations and enforce our Terms of Service; and
  • With your consent where required, send occasional updates about our Services. You can opt out at any time.

Where required by law, we rely on a lawful basis to process your information, such as performing our contract with you, our legitimate business interests, your consent, or compliance with a legal obligation.

4. How we share information

We do not sell your personal information, and we do not rent it or share it for cross-context behavioral advertising. We share information only as needed to run the business or as permitted by law, including with:

  • Service providers who perform functions on our behalf, such as scheduling, payment processing, audio or video conferencing, email, file storage, and analytics, under obligations to protect the information;
  • Professional advisors such as our accountant or attorney, where reasonably necessary;
  • Authorities or other parties where required by law, subpoena, or legal process, or to protect the rights, property, or safety of ProSearch LLC, our clients, or others; and
  • A successor in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

5. Cookies and analytics

The Site may use cookies, pixels, and similar technologies to remember your preferences, keep the Site functioning, and understand how it is used. We may use third-party analytics providers that set their own cookies and process usage data on our behalf. You can control or disable cookies through your browser settings; some features of the Site may not work properly if you do. Where required, we will request your consent for non-essential cookies.

6. Data retention

We keep personal information only for as long as necessary to provide the Services, maintain our business records, resolve disputes, enforce our agreements, and comply with legal, accounting, and tax obligations. Retention periods vary depending on the type of information and the purpose for which it was collected. When information is no longer needed, we delete it or anonymize it.

7. Data security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, or alteration. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any credentials and the information you share with us secure on your end.

8. Your rights and choices

Depending on where you live, you may have rights regarding your personal information, including the right to access, correct, update, delete, or receive a copy of it, to object to or restrict certain processing, and to withdraw consent. You may also opt out of marketing communications at any time. To exercise any of these rights, email us at the address below; we will respond as required by applicable law and may need to verify your identity first. We will not discriminate against you for exercising your rights.

9. International users

We are based in the United States, and the information we collect is processed and stored in the United States and other countries where we or our service providers operate. If you access the Site from outside the United States, you understand that your information may be transferred to and processed in jurisdictions whose data-protection laws may differ from those in your country.

10. Third-party links and services
